EXECUTIVE ORDER NUMBER 6

WHEREAS, I, Governor Robert Bentley, issued Executive Order Number 3 on January 18, 2011, which placed a moratorium on (i) the acceptance and/or processing of any Certificate of Need applications by the State Health Planning and Development Agency (the "SHPDA"), any SHPDA administrative law judge or the Certificate of Need Board (the "CON Board") and (ii) any adoption, re- adoption, adjustment, revision or amendment to or of the State Health Plan by the State Health Coordinating Council (the "SHCC") or SHPDA; and

WHEREAS, after review of the current circumstances, it is clear that this moratorium is no longer necessary, and therefore, it is in the best interest of the citizens of Alabama that the moratorium be lifted.

NOW THEREFORE, based on these considerations, and for other good and valid reasons thereto, I, Robert Bentley, as Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do hereby rescind Executive Order Number 3, issued on January 18, 2011, and thereby lift the moratorium placed on (i) the acceptance and/or processing of any Certificate of Need applications by SHPDA, any SHPDA administrative law judge or the CON Board and (ii) any adoption, re-adoption, adjustment, revision or amendment to or of the State Health Plan by the SHCC or SHPDA.
