EXECUTIVE ORDER NUMBER 31

WHEREAS, Alabama Industrial Development and Training (“AIDT”) was established in fiscal year 1970-1971 as a contract program reporting to the State Board of Education through the division of vocational-technical education, and in 1976, the State Board of Education adopted a resolution approving the establishment of AIDT as a mobile training institute, and thereafter appointed a director, established staff positions and salary schedules, and mandated personnel procedures for AIDT staff identical to those with technical colleges, and AIDT continued operating under the Department of Post Secondary Education when the Alabama Legislature established the department and position of chancellor, and AIDT has been funded through an annual line item in the Education Trust Fund budget since then;

WHEREAS, AIDT has continued to provide quality work force development for Alabama’s new and expanding businesses and has expanded the opportunities of the citizens of Alabama through the jobs these businesses create;

WHEREAS, AIDT is critical to the state’s economic development, job creation and retention, and consistent with the other programs and projects which are now housed in the Department of Commerce; and,

WHEREAS, the services provided by AIDT can more effectively, efficiently and economically be provided through the Department of Commerce.

NOW, THEREFORE, I, Robert Bentley, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do hereby order as follows:

 1.  AIDT shall now be located within the Department of Commerce;

 2.  So long as AIDT continues to receive funding from the Education Trust Fund,   it may continue to make all of its disbursements and payments directly, with  without having to do so through the Comptroller’s office, such payments    including but not being limited to payroll and reimbursements;

 3.  The Secretary of the Department of Commerce shall do all things necessary to relocate and locate AIDT, its property, programs and employees within the Department of Commerce;

 4.  All contracts, grants and agreements previously entered by AIDT shall continue in full force and effect without modification or interruption by this   restructuring;

 5.  All property currently held, leased, owned and possessed by AIDT shall continue to be the property of AIDT within the Department of Commerce;

 6.  All employees of AIDT shall be relocated to the Department of Commerce with the same salary and benefits;

 7.  The other departments and agencies within the state shall do those things necessary to effectuate this change and the purpose and intentions of this executive order.

BE IT FURTHER ORDERED that this Executive Order shall become effective immediately upon its execution and shall remain in effect until amended or modified by the Governor.
