EXECUTIVE ORDER NUMBER 38

WHEREAS, the management of the motor vehicles owned, operated, or leased by the State of Alabama or any agency, board, commission, or department thereof is a key issue of concern to the citizens of Alabama who expect their taxes to be managed in an efficient and effective manner;

WHEREAS, many state agencies maintain and manage vehicles or fleets of vehicles, including the Department of Transportation which utilizes green fleet principles with a rigorous level of accountability in order to achieve the lowest possible operating cost per unit of use as a combination of acquisitions, maintenance, operation, and depreciation/replacement costs; and,

WHEREAS, creating and implementing a plan to analyze and manage the current methods of acquisition, allocation, utilization, fueling, maintenance, repair and disposal of the motor vehicles owned, operated, or leased by the State of Alabama or any agency, board, commission, or department thereof is needed to ensure the most cost efficient use of state resources.

NOW, THEREFORE, based upon the foregoing considerations, and for other good and valid purposes related thereto, I, Robert Bentley, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do hereby rescind Executive Order Number 32, dated May 10, 2006, and order the establishment within the Department of Transportation and under the direction of the Transportation Director, the Office of Fleet Management (OFM), which is hereby charged to implement a plan to manage the motor vehicles owned, operated, or leased by the State of Alabama or any agency, board, commission, or department thereof and develop a Statewide Fleet Management Program.

BE IT ORDERED, that a Fleet Manager shall be appointed by the Transportation Director with the approval of the Governor and shall be employed by the Department of Transportation; provided that, pending the filling of this position, the Transportation Director may designate a person to serve as Interim Fleet Manager, subject to the approval of the Governor.

BE IT FURTHER ORDERED, that the Fleet Manager shall develop and propose for approval by the Transportation Director and the Governor, a Statewide Fleet Management Program to include fleet management policies, procedures, and guidelines which shall provide for the efficient and cost-effective collaborative management of motor vehicles to be used by the State of Alabama or any agency, board, commission, or department thereof in the furtherance of its official duties.  The policies and procedures shall address the following matters:

1.  Cooperation with the Department of Finance and the Green Fleet Review Committee to ensure compliance with the Green Fleets Law (Act 2009-650) which mandated improvements in fuel economy and emissions through life cycle cost procurement of new vehicles and utilization of proven new technologies in existing vehicles.

2.  Consistent with the provisions of Section 41-17A-3, Ala. Code (1975), undertake the development and maintenance of a comprehensive inventory of the entire state fleet of vehicles, which is a specific requirement of the Green Fleets Law (Act 2009-650).

3.  Cooperation with agency heads to assess fleet resources and finalize an accurate baseline inventory by September 30, 2013.

4.  Establishment of criteria for optimum life cycle utilization of vehicles including acquisition, operation, and replacement.

5.  Acquisition of vehicles in accordance with Section 41-17A-5, Ala. Code (1975), using innovative methods for the specific purpose of minimizing the life cycle cost of fleet operations.

6.  Prior to the implementation of the Fleet Management Plan, insure that the Plan does not conflict with Sections 41-17-1, 41-17-3, 41-17-5, and 41-17A-5, Ala. Code (1975), or existing federal law.

7.  To the extent necessary, forward to the Governor by September 30, 2013, any proposed legislative initiatives which may be required before implementation of the plan takes place.

8.  Upon implementation of the Fleet Management Plan, identify and report savings generated by the Plan’s policies and procedures.

BE IT FURTHER ORDERED, within two years of the effective date of this Order, responsibility for managing the acquisition, operation and replacement of all state owned or leased motor vehicles shall be assumed by the Department of Transportation, Office of Fleet Management.

BE IT FURTHER ORDERED, that vehicle acquisition must be accomplished by the use of existing purchasing procedures and approvals.

BE IT FURTHER ORDERED, that all agencies, boards, commissions, and departments of the State of Alabama shall cooperate fully with the Fleet Manager to facilitate the development and implementation of the Statewide Fleet Management Program within two years of the effective date of this Order.

BE IT FURTHER ORDERED, that this Executive Order shall become effective upon its signing by the Governor and shall remain in effect until amended or modified by the Governor.
